Know Your Rights

You must file your claim within one year from the date of injury, or from the date when you became aware of your condition. While your employer may file your injury claim with the Industrial Commission of Arizona (ICA), you are responsible for ensuring that it is filed correctly and before the deadline.

You also have the right to be protected from retaliation in Phoenix. Your employer cannot fire or demote you just for filing a claim. However, the employer is not required to hold your position open for you if you are unable to perform your usual duties because of your injury.

Finally, you have the right to appeal a denied claim or to contest any other decisions contained in the notices you receive — such as the average monthly wage calculation.
